Myster-E-Mail Terms Of Service
ALL RULES AND REGULATIONS SET FORTH HEREIN APPLY TO ALL MEMBERS REGARDLESS OF STATUS (IE UPGRADED OR FREE)
By signing up and actively using the Myster-E-Mail program you agree to all terms and conditions set forth in this agreement.
Myster-E-Mail may, at any time, choose to edit, add and/or delete portions of this agreement and impose changes without prior notification of its members.
Members will be informed of any and all changes to this policy via an email to their primary contact email address provided upon signing up with Myster-E-Mail.
If any modification is unacceptable to you, your only recourse is to terminate
this agreement.
Your continued participation in the Myster-E-Mail program following the posting of a change in policy notice or new agreement on our site will constitute binding acceptance to the change.
Responsibility of Members:
You must be 18 years of age or older to participate in this program.
Our program is open to members from search friendly countries only effective February 1, 2007.
As of February 1, 2007, we accept members from the following countries only:
United States of America, Canada, Australia, Austria, Belgium, Denmark, Finland, France, Germany, Greece, Iceland, Netherlands, New Zealand, Norway, Portugal, Spain, Sweden, Switzerland, United Kingdom.
As of September 18, 2007 no signups from ITALY are allowed. Members from ITALY who sign up after September 18, 2007 will have their accounts deleted IMMEDIATELY!
You agree to and must use your own name and email address in the sign-up process and may not assume a false identity.
You may not sign-up multiple times with different email addresses.
You may not fill in the sign-up form with gibberish or words that a reasonable person cannot understand--if you do so, your account will be DELETED!.
You agree to and must use your full name, address and email address in the sign up process and may not assume a false identity; also abbreviations, gibberish, and terminology such as "home," "here," or "not giving" are not acceptable.
Your computer must not be shared with another individual that has an existing Myster-E-Mail account
As of September 18, 2007 there are no longer any exceptions to this.
Any members who had PRIOR permission from Myster-E-Mail staff BEFORE September 18, 2007 are allowed to stay.
Any members who signup AFTER September 18, 2007 with shared computers, shared physical addresses, shared IP addresses, shared email addresses, shared payment accounts or any other shared aspects of accounts will be deleted and blocked from future signups
Any members who signup AFTER September 18, 2007 with shared computers, shared physical addresses, shared IP addresses, shared email addresses, shared payment accounts or any other shared aspects of accounts clearly DO NOT have PRIOR permission as permission stopped being granted as of September 18, 2007--over 4 months ago!!
As of January 11, 2008 any members found to have shared information (including but not limited to IP address, email address, physical address, payment address) will have their IP blocked at the CPanel level (thereby preventing them from even accessing the site) as well as being blocked in the CC script; their email addresses will not only be blocked in the CC script but will be added to the CPanel email blacklist as well.
Signup Details:
If you choose one or more of the "bad" keywords (such as "Blind Clicker" or "Cheating THIS SITE is 2 FUN") your account may be deleted IMMEDIATELY.
If Myster-E-Mail staff deems it appropriate to SUSPEND your account for this offense (rather than DELETING it) you will have THREE days to uncheck all bad keywords. If you choose not to uncheck said keywords within the stated time period, your account will be DELETED!!
If you re-sign up for the program and again choose one or more of the "bad" keywords
1) your account will be deleted AGAIN.
2) your IP address will be blocked
3) your email address (and payment address, if different) will be blocked.
You will use your email address / password combination to access your account and it is your responsibility to keep this information confidential.
You are responsible for ANY actions taken by ANY person to whom you give your account information, including but not limited to your password.
You may change this information by logging into your account and following the "User Account
Info" link.
All user information can be changed/edited except for your username.
Vacation:
Members may set their account on vacation for a period of time no longer than 30 days (periods of longer than 30 days require you to contact Myster-E-Mail and request an extended vacation period).
Failure to request an extended vacation period will subject your account to deletion for inactivity, thereby losing all pending payouts, earnings, and referrals.
If you place your account on vacation for longer than 30 days without prior notifiication to Myster-E-Mail staff, your account will be SUSPENDED!!
Repeated abuse of the vacation provision (including but not limited to placing your account on vacation every month for the entire 30 day period) will lead to a warning for the first offense and account deletion for the second offense.
If you are found to be abusing the vacation provision (including but not limited to placing your account on vacation numerous times per month without at least 2 weeks between vacation dates) your account will be SUSPENDED!!
If you have a valid reason for placing your account on vacation numerous times per month without at least 2 weeks between vacation dates, this reason MUST be communicated to Myster-E-Mail staff prior to the second (or subsequent) monthly placing of your account on vacation without at least 2 weeks between vacation dates.
Members have 2 weeks *14 calendar days* after the stated return date to resume clicking.
If members do not click within 2 weeks *14 calendar days* of the stated return date, their accounts will be suspended whether or not they are technically inactive.
If members login but do not click within 2 weeks *14 calendar days* of the stated return date, their accounts will be suspended whether or not they are technically inactive.
Search-friendly country members who login from non-search-friendly countries while on vacation will have their account status changed to "free other" which will prevent access to all ptc sections other than the main ptc section and the hangman ptc section. These members will also be forcibly opted out of ptp emails until their return to their home country.
Inactivity:
Accounts are deemed inactive when member(s) have not clicked at least one tracking link or one PTC banner in 60 days.
Accounts that have not clicked at least one tracking link or one PTC banner in 60 days will be suspended for inactivity.
If members who are suspended for inactivity do not contact Myster-E-Mail within 15 days of the original date of suspension will have their accounts deleted for inactivity, thereby losing all pending payouts, earnings, and referrals.
Clicking cheat links/cheat banners does NOT count towards the click requirement and may lead to deletion of accounts.
Just logging in does NOT count towards activity requirements
If your account is unsuspended and you still do NOT click anything for THREE (3) days or more your account will be suspended AGAIN and your inactivity period will be counted from the date of FIRST suspension not the date of contacting Myster-E-Mail to be unsuspended.
Members who have placed themselves on vacation are exempt from activity requirements ONLY until the date of stated return from vacation.
Members have 2 weeks *14 calendar days* after the stated return date in their user information to resume clicking.
If members do not click within 2 weeks *14 calendar days* of the stated return date in their user information, their accounts will be suspended whether or not they are technically inactive.
Accounts deleted for inactivity are NOT able to be reinstated.
Use of Account by Yourself and Others:
You are solely responsible for any and all use of your Myster-E-Mail account including authorization by you to any third party individual who may use your account.
Fraud, System Abuse, Inappropriate/Illegal Activity:
Should any instances of fraud, system abuse, or any type of activity deemed to be inappropriate or illegal by Myster-E-Mail be detected it may result in member termination (thereby losing all pending payouts, earnings, and referrals) and possible legal action.
Any solicitation of advertisers for a confirmation email for purposes of receiving credit in your account will be grounds for immediate termination, thereby losing all pending payouts, earnings, and referrals.
Email Account Information:
You must maintain your email account that you used when signing up with Myster-E-Mail or provide an alternate email address.
You agree to receive e-mail advertising from Myster-E-Mail limited to no more than 100 emails per day.
In the event your e-mail account returns emails to us (for any reason) five (5) or more times in a ten (10) day period, your Myster-E-Mail account will be placed on site inbox only! If 10 or more emails bounce in any one given day, your Myster-E-Mail account will be placed on site inbox only!
If you set your Myster-E-Mail account back to email address or email address/site inbox but your email account continues to bounce back to us your account will be fined $1.00 for each bounce received. AFTER TEN BOUNCES YOUR ACCOUNT WILL BE DELETED!!
AOL email addresses are not allowed at this site effective January 11, 2008!!
You are NOT allowed to use hotmail, MSN, Yahoo, or AOL accounts for receiving email.
All Hotmail and MSN email addresses were placed on site inbox only as of June 3, 2007 and any member who switches back to email address only without first changing from a Hotmail/MSN email address will be fined $1.00 for each bounced email received; there is NO limit to the amount of fines that will be levied.
All AOL email accounts were placed on site inbox only as of January 11, 2008 and any member who switches back to email address only without first changing from an AOL email address will be fined $1.00 for each bounced email received; there is NO limit to the amount of fines that will be levied.
All Yahoo email accounts were placed on site inbox only as of August 10, 2008 and any member who switches back to email address only without first changing from an Yahoo email address will be fined $1.00 for each bounced email or delayed delivery notice received; there is NO limit to the amount of fines that will be levied.
Abuse of Myster-E-Mail Staff:
Any member sending Myster-E-Mail gibberish or abusive mail (including but not limited to swearing at the staff of Myster-E-Mail) will result in automatic termination of account and forfeiture of all earnings to date of termination. This also applies to any member abusing Myster-E-Mail staff in any online forum or via instant messenger.
Auto-Responders:
Auto-responses will also be deleted immediately after the third occurence of such.
Relationship of the Parties:
You and Myster-E-Mail are independent contractors, and nothing in this Agreement creates any partnership, joint venture, agency, franchise, sales representative or employment relationship between you and Myster-E-Mail.
You understand that you do not have authority to make or accept any offers or make any representations on behalf of Myster-E-Mail.
You may not make any statement, whether on your site or otherwise, that would contradict anything in this section.
You are solely responsible for the reporting and payment of any taxes for money earned while using the program.
Limitation of Liability:
Myster-E-Mail will not be liable for lost profits, lost business opportunities, or any other indirect, special, punitive, incidental or consequential damages arising out of or related to this agreement or the Myster-E-Mail program, even if Myster-E-Mail has been advised of the possibility of such damages.
Furthermore, Myster-E-Mail aggregate liability arising under this Agreement will not exceed the amount of the total fees paid or payable to you under this Agreement. The provisions of this Section survive termination or expiration of the Agreement.
Inappropriate Advertising Content:
Myster-E-Mail will not accept advertising with inappropriate content. This includes but is not limited to:
advertising including ANY adult images or content
advertising supporting ANY political candidate
advertising regarding the issue of race
advertising regarding ANY religious issues.
Myster-E-Mail also maintains a "banned list" found here BANNED SITES and will NOT accept any advertising for any site on this list (the list is subject to change at any time also so check it BEFORE purchasing or redeeming for advertising!!)
Payments and Earnings:
What must I do to earn from this site?
In order to earn, you must click the links found in each paid email sent by Myster-E-Mail.
In order for your account to be credited, you must allow the advertisers page to open and also allow the timer to run down. Opening more than one link at a time is NOT allowed as of February 3, 2008. You may need to respond to administrative messages before being allowed to earn.
You may also click PTC in the various ptc sections (some country restrictions apply); in order for your account to be credited for clicking PTC banners, you must allow the timer to run down. You may need to respond to administrative messages before being allowed to earn.
Other earnings opportunities include:
referring new members to the program
participating in games available on the site (currently hangman and trivia are installed, more games may be installed in the future)
clicking contest PTC (after a certain number of banners is clicked, a winner is picked RANDOMLY by the Contest PTC Plugin)
Winners get 10 cents added to their Myster-E-Mail account, there are NO advertising prizes awarded as a result of winning the 10 cents from Contest PTC.
Other earning opportunities may be added in the future.
You are NOT allowed to open multiple links at the same time effective February 3, 2008.
Members will earn a percentage of advertising revenues collected by Myster-E-Mail.
Members will be paid via their choice of the available payout methods listed below:

MONEYBOOKERS, CHECKS, STORMPAY, INTGOLD, ALERT PAY, NETELLER, NETPAY, ARE NOT PAYOUT OPTIONS AT THIS SITE AND WILL NOT BE PAYMENT OPTIONS IN THE FUTURE!!
Myster-E-Mail will pay members when their balance reaches the minimum payout rate set by Myster-E-Mail which is currently NO MINIMUM PAYOUT.
There are many random payouts made per month; if you do not wish to be paid anywhere from 2-12 times per month, you MUST set your account to "Save up ($5.00 max)" in your user account information.
If you return/deny/reject a PayPal mass pay of any amount, your account will be edited to "Save up ($5.00 max)" and you will be fined 50 cents!! This fine will not be removed until you personally have resolved any issues with PayPal!!
If you do not provide a valid payment account in the "payment account ID" area, your account will be edited to "Save up ($5.00 max)."
Money orders are available to USA/Canada ONLY and have a fee of $1.50 USD.
MEMBERS WITH DIFFERENT USER NAMES ARE NOT ALLOWED TO HAVE PAYMENTS GOING TO THE SAME PAYMENT ACCOUNT WITHOUT (1) A WRITTEN EXPLANATION FROM ALL MEMBERS INVOLVED AND (2) PRIOR PERMISSION FROM MYSTER-E-MAIL STAFF.
IF MYSTER-E-MAIL STAFF FINDS MULTIPLE ACCOUNTS WHICH HAVE THE SAME PAYMENT ACCOUNT AND NO EXPLANATION and/or PRIOR PERMISSION, ALL ACCOUNTS INVOLVED WILL BE DELETED WITHOUT PRIOR NOTICE!!
ALL PAYMENT RELATED RULES APPLY TO ALL MEMBERS, WHETHER UPGRADED OR NOT!!
Payments will be made randomly multiple times per month with no request (some payment methods not included!) to all members who have .01 or more in their accounts.
Payments are shown in your user information as "Commission Payment".
If you wish to be paid randomly by PayPal mass pay or by E-gold you MUST place a valid PayPal email address or a valid E-gold number in the space provided for it (Payment account ID).
If you leave this space blank or enter invalid information your account will be edited to "Save up ($5.00 max)" and you will NOT be paid until your account reaches $5.00 USD unless you provide valid information.
Please note that there is a $1.50 USD charge for Money Orders and they are available ONLY to USA/Canada. Any member from outside the USA/CANADA who requests a money order will have their account edited to "Save up ($5.00 max)" and will not be paid until and unless they supply a valid payout method.
Minimum amount for ANY of the gift certificate options is $5.00 USD
Spam:
You may not promote your referral links through unsolicited emailing (i.e. SPAMMING), newsgroup postings, or any other method of mass communication.
Failure to comply will result in immediate termination of your membership with Myster-E-Mail and may result in legal prosecution.
If your account is deleted for spamming you are not allowed to join the program again; your IP and email address will be blocked to prevent future signups.
Myster-E-Mail strictly enforces anti-spam laws.
Spamming is a federal crime.
Any member caught spamming will not only have their account terminated immediately and lose any past, present and future earnings, but shall also be held liable for spamming as we shall cooperate with any authorities and investigations that may arise from the spamming incident.
Myster-E-Mail may charge up to $5.00 per spam email sent.
Multiple Signups:
Multiple sign-ups shall be grounds for immediate termination of all involved accounts. Signing up multiple times from the same computer also constitutes fraud. Myster-E-Mail will file charges for recovery of any earnings received from multiple sign-ups.
SEARCHES:
Any member who does not reside in a search friendly country (United States of America, Canada, Australia, Austria, Belgium, Denmark, Finland, France, Germany, Greece, Iceland, Italy, Netherlands, New Zealand, Norway, Portugal, Spain, Sweden, Switzerland, or the United Kingdom) who checks off searches or admin searches as an interest will be DELETED for CHEATING.
Any member who does not reside in a search friendly country that clicks on search links sent out in search only emails will also be DELETED for CHEATING.
Any member who does not reside in a search friendly country that clicks search PTC:
1) first offense: ALL ptc earnings deleted. 50 cent fine to account.
2) second offense: ALL ptc earnings deleted. $1.00 fine to account. Account suspended.
3) third offense: account DELETED for CHEATING, thereby losing all pending payout requests, earnings and referrals.
If you are from a country which is permitted to search and have searches selected as one of your interests I would like to say the following: I am not permitted to ask or demand that you make a search if you click on the link. But what I would like to make sure that you are aware of, is the fact that clicking on the link without making a search increases site debt and will ultimately cause delays in payments, including yours. I do have campaign tracking script which allows me to know who is performing a search and who is just clicking the link. If I see that you habitually just click the link, I do have the right to remove searches from your interests and will do so. If you have a open proxy ISP such as AOL and are found to be clicking search links and/or search PTC, I will also remove searches and admin searches from your interests.
TARGETED PTC SECTIONS:
If you are from a country other than the USA and found to be clicking PTC in the USA only, USA/UK/CANADA only, or the site support (usa only) sections, your account will be deleted, thereby losing all pending payout requests, earnings and referrals.
If you are from a country other than USA/UK/CANADA and found to be clicking PTC in the USA/UK/CANADA only section, your account will be deleted, thereby losing all pending payout requests, earnings and referrals.
If you are not from a search-friendly country and found to be clicking PTC in the search section, your account will be deleted, thereby losing all pending payout requests, earnings and referrals
DELETED ACCOUNTS:
Deleted accounts will be purged from the system within one (1) week (7 days) of deletion, unless accounts were deleted for any form of cheating. Accounts deleted for cheating will be canceled but not purged
EMAIL BOT CATCHER LINKS:
Any member who clicks a bot catcher cheat link three or more times will be deleted from the membership of Myster-E-Mail, thereby losing all pending payout requests, referrals and earnings. IP addresses and email addresses will be blocked.
THESE MEMBERS WILL NOT BE REINSTATED FOR ANY REASON!!
If you contact me 2 weeks after the fact and accuse someone else of clicking the cheat links it will not change anything -- you are responsible for safeguarding your account password and you are responsible for ANY actions taken by any person to whom you give account access.
If you are deleted for clicking a bot catcher cheat link three or more times, you are not allowed to have a NEW account with Myster-E-Mail under any username!!
CHEAT CATCHER KEYWORDS:
Any member who chooses one (1) or more of the nineteen (19) cheat catcher keywords on the user information page will be deleted with no warning, thereby losing all pending payouts requests, referrals and earnings.
If members signup again and again choose (1) or more of the nineteen (19) cheat catcher keywords on the user information page will be deleted with no warning, thereby losing all pending payouts requests, referrals and earnings. The second offense will also result in banning the IP address and blocking the email address of the offending member.
MUTUALLY EXCLUSIVE KEYWORDS:
Any member who chooses "I am Male" AND "I am Female" on the user information page will be suspended with no warning. If members who choose both these keywords do not contact Myster-E-Mail within 15 days of suspension, the account will be deleted with no warning, thereby losing all pending payouts requests, referrals and earnings.
Any member who chooses "I am Married" AND "I am Single" on the user information page will be suspended with no warning. If members who choose both these keywords do not contact Myster-E-Mail within 15 days of suspension, the account will be deleted with no warning, thereby losing all pending payouts requests, referrals and earnings.
Any member who chooses "No Random Payouts" AND "Pay me 2x per week" on the user information page will have their payment information edited to "save up ($5.00 max)" and will not receive any payments.
Any member who chooses "HOLD EARNINGS FOR ADS" AND "Pay me 2x per week" on the user information page have their payment information edited to "save up ($5.00 max)" and will not receive any payments.
CHEAT CATCHER PTC:
Any member who clicks the cheat catcher PTC in the various PTC sections three (3) times or more without informing Myster-E-Mail staff of said clicks will have their account deleted, thereby losing all pending payouts requests, referrals and earnings.
Negative balances due to one or more clicks on cheat banners will be reversed only up to 3 times per calendar month and ONLY if members have informed Myster-E-Mail staff of said clicks on cheat catcher ptc banners.
Their email address and IP address will both be blocked to prevent future signup(s) to the program.
THESE MEMBERS WILL NOT BE REINSTATED FOR ANY REASON!!
If you are deleted for clicking cheat catcher PTC three or more times, you are not allowed to have a NEW account with Myster-E-Mail under any username!!
OTHER CHEATING METHODS:
Allowing other people access to your account for the express purpose of clicking more than you could click on your own is considered cheating and is grounds for termination of your account. This includes 'classmates,' friends, relatives, spouses, children. Human click bots are not accepted at this site any more than software click bots are. If your pattern of earnings appears to be suspicious, your account will be suspended until an explanation is received. If the explanation is that you are allowing other people to click for you, your account will be DELETED and you will not be allowed to join again!!
ADMIN MESSAGE RESPONSES:
Admin messages are sent to (1) communicate with members (2) serve as English tests (3) determine if members are paying attention to what they read.
Member responses to admin messages may lead to suspension of accounts or deletion of accounts (thereby losing all pending payouts, earnings, and referrals) depending on exact response.
Members who chose any variation of "delete my account" as a response to an admin message will have their accounts deleted (IP/email address will be blocked also) whether or not they actually wanted their accounts deleted!!
Failing 3 english tests during the lifetime of membership will lead to deletion of account, with IP and email address blocked to prevent future signups.
AFFILIATE PAGES
You may not promote your affiliate page in any auto surf traffic exchange.
If you are found to be promoting your affiliate page in any auto surf traffic exchange your affiliate page will be disabled and your payment for the page will NOT be refunded.
ENCOURAGING CHEATING OF THE SITE:
Any member caught encouraging or promoting cheating of Myster-E-Mail will be deleted.
Members deleted for this reason are NOT allowed to join again, and their IPs and email addresses will be blocked to prevent future signups.
SHARING INFORMATION ABOUT CHEATERS:
Myster-E-Mail reserves the right to share information about members deleting for cheating with other program owners as necessary.
UPGRADED MEMBERS AND AFFILIATE PAGE HOLDERS
If your account is upgraded and you are deleted for ANY reason, your upgrade fee will NOT be refunded. Upgraded members are subject to the same rules and regulations as free members.
If you have purchased an affiliate page and your account is deleted for ANY reason, the affiliate page fee will NOT be refunded. Affiliate page holders are subject to the same rules and regulations as all other members
SPAMMING THE PROGRAM OR PROGRAM STAFF
Members are NOT allowed to spam the program's email addresses or addresses from which they have received payments.
This includes but is not limited to social networking invitations, ads/links for other sites, and auto-responders including ads/links for other sites.
If members spam the program, program staff, or payment addresses they risk having their accounts suspended, having their accounts being fined, having their accounts deleted, and losing their earnings and/or accounts at the programs whose links they are spamming.
Definition of Spam: If Myster-E-Mail staff did not ask for the link then sending it to Myster-E-Mail staff is SPAM.
Just because program addresses or payment addresses are in your address book does not give you permission to SPAM the program or the staff.
As of October 3, 2008, any member who sends spam to program email addresses, private email addresses or my messengers will receive one and only one warning. If it happens again, the member's account will be terminated and earnings forfeited.
UNSUBSCRIBE REQUESTS
If you wish to unsubscribe from the program, you may send an email request to

(requests sent to rewards@myster-e-mail.com will not be honored as this is an unattended mailbox used for receiving notices of returned [bounced] emails)
REQUESTS MUST COME FROM THE EMAIL AT WHICH YOU ARE RECEIVING PAID EMAILS, REQUESTS FROM ANY OTHER EMAIL ADDRESS WILL NOT BE HONORED
Please allow 7-10 business days for your request to be processed.
You will receive email confirmation that your account has been deleted.
Multiple unsubscribe requests received in any one 24 hour period will cause your IP/email address to be blocked to prevent future signups.
Abusive unsubscribe requests (including but not limited to the use of foul language) will result in your IP/email address being blocked to prevent future signups.
Accounts of members leaving the program willingly and under good circumstances will be purged from the database within 24 hours of deletion. All other accounts deleted for any reason will remain in the database until such time as this site is closed or sold.
CONFIDENTIALITY:
Any emails, links, admin messages or other communication which are received from Myster-E-mail may NOT be reproduced in any form or posted in any forum other than Myster-E-Mail's own forum without the PRIOR express WRITTEN permission of Myster-E-Mail.
Currently the only person/site granted this PRIOR express WRITTEN permission--to post admininstrative messages ONLY--is usdollars, the PO of Been Paid.
If you reproduce in any form or post any emails or other communication in any venue without PRIOR express WRITTEN permission from Myster-E-Mail, your account will be terminated immediately and without notice, thereby losing all pending payout requests, earnings and referrals. Members deleted for violating this confidentiality rule are not allowed to rejoin the program under any circumstances or for any reason.
